This is a situation that affects a significant number of people each year and can feel very alarming, but there are clear rules about what happens and what your options are.
What happens when your sponsor loses its licence:
When a sponsor's licence is revoked or suspended, the Home Office will normally curtail (shorten) your leave to remain. You will usually be given 60 calendar days from the date of the curtailment notice, or until your existing leave expires, whichever is shorter. This replaced the previous, shorter periods and was confirmed by Home Office guidance updates.
During that 60-day period you have lawful leave to remain in the UK and can take steps to regularise your position.
Your options within the 60-day window:
1. Find a new Skilled Worker sponsor. If another employer is willing to sponsor you, they can assign you a new Certificate of Sponsorship and you can submit a fresh Skilled Worker visa application from within the UK. This is the most straightforward route if you can act quickly. You do not need to leave the UK to do this provided you apply before your curtailed leave expires.
2. Switch to another visa category. If you are eligible for a different immigration route, for example a Partner visa, a Graduate visa (if you qualify), a Global Talent visa, or another work route, you may be able to apply to switch before your leave runs out.
3. Apply under Article 8 of the European Convention on Human Rights. If you have strong private or family life ties to the UK, you may in some circumstances be able to make a human rights-based application, though this is generally harder to succeed on and should not be relied upon as a primary strategy.
4. Leave the UK voluntarily. If none of the above options is viable within the timeframe, it is far better to leave voluntarily before your leave expires rather than overstay, as overstaying can lead to a ban on future UK immigration applications, typically of one year if you overstay by up to 30 days, and longer for more extended overstays.
Important practical points:
The 60-day curtailment period starts from the date stated in the Home Office letter or email, not from the date you actually receive it. Check your correspondence carefully and note the exact date.
If you submit a valid in-time application to switch visa category or to a new Skilled Worker sponsor before your curtailed leave expires, your leave is extended by operation of law under section 3C of the Immigration Act 1971 until that application is decided. This means you will not become an overstayer while your application is pending, even if the decision takes longer than 60 days.
Your dependants' leave will also usually be curtailed on the same basis. They will need to make their own applications to switch or extend, typically aligned with yours.
If your sponsor's licence is merely suspended rather than revoked, the position is slightly different. During suspension your visa is not immediately curtailed, but you cannot work for the sponsor while the licence is suspended. If the suspension is lifted and the licence reinstated, normal service resumes. If the licence is then revoked, the curtailment process begins.
What to do now:
Check the exact date on any curtailment letter from the Home Office and work backwards to establish your deadline.
Begin looking for alternative sponsors immediately. The Home Office publishes a register of licensed sponsors which is publicly available and searchable.
If you have a partner who is a British citizen or settled person, explore whether a Partner visa application is viable.
Keep copies of all correspondence from the Home Office and your former employer.
If you are in any doubt about the deadline or your eligibility to switch, getting advice quickly is important because the 60-day window is strict and missing it has serious consequences.
One further point worth noting is that it is not your fault that your sponsor lost its licence, and the Home Office does generally recognise this by giving you the 60-day grace period rather than requiring immediate departure. The system is designed to allow you a reasonable opportunity to find another route, but it does require prompt action.
