Penalty points for no insurance mistake

Question
Can I avoid points for no insurance if the mistake was not my fault?

Hello there. I am Gemma, your legal assistant from Lawyer Destroyer. I can certainly help explain where you stand with this and how you might be able to keep your licence clean.

The basic legal position:

Driving without insurance is what the law calls a strict liability offence. This means the police or the court do not need to prove that you intended to drive without insurance, or that you were deliberately risking it. Simply driving a vehicle without a valid policy in place makes you guilty of the offence, even if it was a complete, genuine mistake.

Because of this, you usually cannot plead not guilty simply because the lack of insurance was not your fault.

Avoiding the penalty points:

Although you may be technically guilty, the law recognises that sometimes people are let down by others. If the situation was genuinely out of your control, or a very specific mistake misled you, you can argue something called Special Reasons.

If the magistrates agree that you have a Special Reason, you still plead guilty to the offence, but the court can use its discretion to not give you the usual 6 to 8 penalty points or issue a fine.

What counts as a Special Reason:

To be successful, a Special Reason must be a mitigating circumstance that is directly connected to why you were driving without insurance. It cannot just be about how much you need your driving licence for work or family.

Courts will sometimes accept a Special Reason in situations like these:

1. Your insurance company cancelled your policy by mistake, or cancelled it without sending you any notification.
2. A parent, partner, or employer explicitly told you that they had arranged insurance cover for you to drive the vehicle, and you had a genuine and reasonable belief that they were telling the truth.
3. You were misled by an insurance broker or the insurance company about the level of cover you had.

However, the courts are quite strict. They will usually not accept a Special Reason if you simply forgot to renew your policy, if your direct debit bounced because you did not keep an eye on your bank balance, or if you misunderstood your policy because you did not read the terms and conditions properly.

Practical next steps:

1. Look out for the police correspondence. If the police catch you without insurance, they will usually offer you a Fixed Penalty Notice of 6 points and a 300 pound fine.

2. Decline the Fixed Penalty Notice. You cannot argue Special Reasons through a Fixed Penalty Notice. The only way to avoid the points is to decline the police offer and let the matter go to a Magistrates Court.

3. Gather your evidence. You will need rock-solid proof that the mistake was not your fault. The court will not just take your word for it. You should gather emails or letters from your insurance company admitting they made an error, bank statements showing payments going out for a policy that they claim did not exist, or a written witness statement from the person who misled you into thinking you were insured.

4. Respond to the court summons. When you receive the court paperwork, you will usually need to indicate that you are pleading guilty but claiming Special Reasons not to endorse your driving licence with points.

5. Attend the court hearing. The court will hold a specific hearing where you will need to explain exactly what happened, present your documents, and give evidence under oath.

Please note that going to court carries a slight risk. If the magistrates decide your reason is not quite special enough, they will impose the penalty points, and the court fine will likely be higher than the original fixed penalty offer, plus you will have to pay court costs. It is always worth carefully weighing up how strong your evidence is before making a final decision.
