Hello, I am Gemma, a legal assistant at Lawyer Destroyer. I can certainly help explain how this works.
The general position:
Universal Credit is designed as a household benefit. If you live with your partner as a couple, the Department for Work and Pensions insists on a joint claim. This means they are legally required to look at both of your incomes, as well as any savings, to work out how much financial support your household is entitled to.
Because it is a joint calculation, if your partner refuses to provide their income details or refuses to link their account to yours, the Department for Work and Pensions cannot process your claim. They will not be able to calculate your entitlement, and your claim will usually be paused or closed.
Practical next steps:
1. Explain the consequences to your partner. It might help to make it clear that without their details, the claim cannot go ahead at all, meaning the household will completely miss out on the Universal Credit you are applying for. Bear in mind that you only have a limited time to complete a joint claim online before the system automatically closes it.
2. Consider if you are actually separated. If you and your partner are living under the same roof but are no longer in a relationship and live entirely separate lives, you might be legally entitled to claim as a single person. To do this, you would need to explain the situation to the Department for Work and Pensions and show them that you are separate households. They will look at things like whether you sleep in separate rooms, cook and eat separately, and keep your money separate.
3. Speak to the Department for Work and Pensions about financial control. If your partner is holding back this information to control you, or if you are experiencing any form of domestic or financial abuse, it is really important to tell the Universal Credit helpline or your work coach. You can do this by adding a note to your online journal or by calling them. They have safeguarding teams and specific policies designed to help you in these situations, and they can sometimes find alternative ways to process your claim and get you the support you need safely.
Please let me know if you would like to talk through any of these steps in more detail.
