Driving legality during DVLA licence renewal

This is a common question and the answer depends on exactly which type of renewal you are waiting for.

Driving while a renewal application is pending with the DVLA:

The general rule is that you can continue to drive while waiting for the DVLA to process a renewal application, but only if certain conditions are met. The legal basis is section 88 of the Road Traffic Act 1988.

Section 88 allows you to drive provided all of the following apply:

1. You submitted your renewal application before your old licence expired.
2. You meet the physical fitness requirements to hold a licence (you have not been told you are unfit to drive).
3. Your previous licence was not revoked or refused for medical reasons or as a result of a disqualification.
4. You are not currently disqualified from driving.
5. If the renewal involves a medical application (for example, a section 92 renewal for a notifiable medical condition, or renewal at age 70), your doctor has not told you that you should not be driving.
6. You would otherwise meet the conditions for holding a licence.

If those conditions are met, section 88 provides a lawful basis to drive even though you do not physically hold a current photocard licence.

Important practical points:

You should keep evidence that your application was submitted before the old licence expired. A screenshot of an online submission confirmation, postal receipt, or similar proof is sensible. If you are stopped by police, you may need to explain the position.

Your insurance should remain valid while you are driving under section 88, because you are driving lawfully. However, it is worth checking with your insurer, as some policies have unusual wording or may require notification.

If the DVLA has specifically told you not to drive, or if your licence was surrendered or revoked rather than simply expiring, section 88 will not protect you and you must not drive.

Where it gets more complicated:

If you are renewing because of a medical condition, and the DVLA is carrying out medical investigations, there can be lengthy delays. During that time, section 88 still applies as long as you have not been told you are unfit to drive. But if at any point the DVLA writes to you and says you must not drive, or your doctor advises you to stop, you must stop immediately regardless of whether the renewal is still in progress.

If your licence expired and you did not apply before the expiry date, section 88 does not apply and you must not drive until the new licence is issued.
